Interoperability and Patient Access - Final Rule (CMS-9115-F) Deadlines

Important dates on the Cures Act Timeline related to Patient Access are approaching. With information from a number of regulatory bodies, it is often challenging to keep all of the dates organized. 

The Cures Act may have been historic in multiple ways, but one of the most relevant for our discussion here was that both CMS and the ONC published their final rules on the same date AND that date was the first of a month - May 1st, 2020. This has rarely happened in healthcare regulation land. 

These two important facts make it slightly easier for those of us who had been following the legislation to remember and calculate dates. Many people were a bit excited about that. Well, maybe not many people, but the true healthIT geeks were really over the moon. 

But then the COVID-19 pandemic was declared and both agencies issued modifications to the timeline as a result of the pandemic. This time, we weren’t so fortunate when it came to keeping things in sync. 

The ONC and CMS took different approaches to the timeline adjustments.

The ONC issued an ‘Enforcement Discretion’ to their timelines. Many of the compliance dates were given a three-month enforcement discretion window. The ONC was clear to differentiate this from a timeline extension or timeline change. The expectation was clear that the original timeline was still the desired timeframe for compliance, but the enforcement discretion window could allow for a grace period if needed. 

CMS delayed the compliance on the regulation that required a Patient Access API and Provider Directory API by six months. CMS also delayed the compliance for the ADT Notifications by one year.

With multiple regulatory bodies, multiple regulated entities, multiple individual regulations, multiple compliance dates, and multiple timeline changes, the information becomes hard to manage. A comprehensive timeline seems to be the only way to keep track of the information.

There are so many cute ideas on Pinterest where you can find inspiration, not to mention tips on color-coding. Keep this calendar up to date! Regular doctors’ appointments are crucial to keeping you and your family’s health in check now and preventing something serious down the road. 

Keep A List of Important Contacts in a Central Location

You know that list of emergency contacts that you stick on the fridge for babysitters? You need access to that list, too. It should have all of the family’s care providers on it. Emphasize the emergency contacts, of course, but all of your doctors should be listed. This is another opportunity for color-coding! Bonus points if your list of contacts is near the wall calendar, though keeping it on the fridge is still an option. 

This can certainly feel like a daunting task. A three-ring binder could be helpful here. The website offers a vendor and platform agnostic location to help consumers select a health care application of their choice to aggregate their clinical, coverage, and payment information.

My Health Application was created by the CARIN Alliance because they recognized the need for a centralized vendor and platform agnostic location for individuals to find applications that would allow them to access and utilize their health data. Individuals will find applications on the website who have attested to the CARIN code of conduct, an industry-leading set of privacy, security, and consent guidelines for consumer-facing applications to follow when handling health information. 

When users click on ‘Select an App’, they will find detailed screenshots and information for each application on the ‘Application Gallery’ page. In addition to the CARIN code of conduct, users will also find applications who are affiliated with other trusted sources such as the Centers for Medicare and Medicaid Services (CMS), the Veterans Health Administration, Carequality, CommonWell Health Alliance, 1up Health, and Apple Health. Applications who are affiliated with these trusted sources will help begin to establish trust over time. The consumer can easily link to the application’s privacy policy and terms of service so they can access information about how the application is accessing, using, and storing the consumer’s health information. Over time, the website may include an application’s third-party certifications once those services become more widely available in the market. 

The CARIN Alliance envisions a future where consumers can choose an application of their choice to retrieve both their complete health record and complete coverage information from any provider or health plan in the country based on their individual consent sharing preferences. My Health Application helps consumers accomplish that goal by offering a transparent way for them to view consumer-facing applications in a single location.

When To Share Your Medical Records with Your Family

Your personal medical records are exactly that: they are “yours” and they are “personal.” They contain much of your most sensitive information, and it would make sense that they would remain private for your eyes and your eyes only. What is an Electronic Health Record?

Think back to a time long ago. A time before cell phones. A time before the internet. A time when doctors kept their patients’ records in physical files on actual pieces of paper. Seems pretty old-fashioned, doesn’t it? Now almost everything is digital, including medical records. Electronic Health Records (EHR) have been a key part of the digital transformation of healthcare. Read on to find out what EHRs are, their benefits, and where you can find yours. 

An EHR contains a physical medical chart but it’s digitized. While the medical chart is its biggest component, it also has features such as electronic prescribing, orders tracking, flowsheets, interfaces to lab companies, immunization registries, and more.
